The present Policy describes the way, whereby we process your personal data as Processors, namely for and on behalf of your respective employer, to whom we provide our agency services and/or the hospitals/clinics/dental centers/hotels with which we cooperate. We collect your personal data in the course of our business and always within the scope of applicable data protection legislation.

Who is the Controller of your Personal Data

Controller of your personal data is your respective employer, with which we cooperate/to whom we offer our agency services and/or the hospitals/clinics/dental centers/hotels with which we cooperate and which provide their services to you.

The respective data controller defines the categories of personal data we process.

The personal data we collect and process for and on behalf of the data controller may differ depending on the processing purpose and the nature of our/your contractual or other relationship with the data controller.

Taking into account that the object of our company is, inter alia, the provision of agency services, the personal data that we may collect and process for and on behalf of the data controller, include the following categories of data:

Contact data

First name, last name, mailing address, e-mail address, telephone number, fax number etc.

General information

Sex, marital status, date and place of birth, physical features

Information regarding your education and work status

Education, employer data and history of employment, skills and experience, professional licenses

Official identification data

ID number, passport number, driver's license number, VAT number, social security number and any other official identification data

Health data

Current or former physical or mental health or dental state, information regarding injuries or disabilities/handicaps, medical diagnoses, test results, data included in medical files, medical procedures and treatment, personal habits (for example smoking or alcohol consumption), prescription of drugs and medical and dental history

Information for our compliance with legislation regarding the legalization of income from illegal activities

Information which we are obliged to collect in order to comply with legislation regarding the legalization of income from illegal activities

The legal bases for the processing of your personal data

As per applicable data protection legislation, the processing of your data takes place, as the case may be, according to one of the following legal bases:

-        you have given your consent to the processing of your personal data for one or more specific purposes;

-        processing is necessary for the performance of a contract to which you are a party or to take steps at your request prior to entering a contract;

-        processing is necessary for compliance with a legal obligation to which our company or the data controller is subject;

-        processing is necessary in order to protect your vital interests; and

-        processing is necessary for the performance of our agreement with the data controller

The collection and processing of special categories of personal data (for example health data etc.) takes place according to one of the following legal bases:

-        processing is necessary for the purposes of us or the data controller carrying out the obligations and exercising specific rights in the field of employment and social security law;

-        processing is necessary in order to protect your vital interests;

-        processing is necessary for the establishment, exercise or defense of legal claims or wherever courts are acting in their judicial capacity; and

-        processing is necessary for the purposes of preventive or occupational medicine, for the assessment of your working capacity, medical diagnosis, the provision of health or social care or treatment.

Purposes of Personal Data Processing
The nature and purpose of processing are defined by the data controller.

It is noted, however, that the company generally processes for and on behalf of the data controller your above personal data for the following purposes:

a) In order to provide its agency services to its customers;

b) in order for embarkation/disembarkation/medical/dental/accommodation services to be provided to you and/or your respective employer;

c) comply with our legal obligations with the hospitals/dental centers/hotels we cooperate with; and
d) in order to comply with the obligations dictated by the applicable, from time to time, legal and regulatory framework and mainly for purposes which relate to the prevention and suppression of legalization of income from illegal activities, the avoidance and combating of fraud and financing terrorism as well as the application of Greek Tax Legislation.

Recipients

Your personal data may be forwarded to other companies or the competent authorities in case it is necessary to investigate a possible fraud, to affiliates of the company as well as to other natural persons or legal entities who cooperate with the company in the context of the lawful operation of the agency agreements with the company's customers and of the performance of health/dental/accommodation agreements with the company's associates, to the extent required for your/the company's customers better service, as well as for the provision of services from companies acting on behalf of the company in performance of the terms and conditions of the company's agreements with its customers/associates, companies vested with the safekeeping and retaining of archives on behalf of the company, telephone customer care companies, lawyers, investigators, experts. In this case, the company undertakes that its associates are subject to the control and act only under its and/or the respective data controller's instructions, have been especially authorized to that end and are fully bound by the privacy and obligations provided for in the legislation in relation to the collection and processing of the above data.

In addition, the Company may disclose your data to the competent public/court authorities, to the extent dictated by the applicable legislative and regulatory framework, if a relevant motion is filed or if it is obligated – in its capacity as agent or otherwise - to file a report/list with the said data without any special notice being required.

Finally, you should note that we may transmit data to third countries (outside the European Union or the European Economic Area that is); we will only do so for the purpose of fulfilling our contractual or legal obligations, due to a legal obligation or based on our legitimate interests. In any case, we ensure that your personal data is processed in compliance with applicable data protection legislation.

The applicable data retention period is set by the data controller.

We undertake to keep your data up-to-date and accurate, store them and securely delete them, not to collect and retain data which is not necessary for us, to protect your data against any loss, misuse, unauthorized access or disclosure thereof and in general to ensure the existence of the appropriate technical and organizational measures for their protection. Your rights

You have the following rights:

-        to request access to your Personal Data. Such right includes, inter alia, the origin of the data, the processing purpose(s), the relevant categories of Personal Data, the recipients or the categories of recipients to which your Personal Data were disclosed or will be disclosed, the envisaged period for which your Personal Data will be stored and the development of the processing since the latest briefing;

-        subject to par. 3 of Art. 17 of the above Regulation, to erase your Personal Data (right to be forgotten), should one of the reasons mentioned in par. 1 of such article be applicable;

-        to rectify your inaccurate Personal Data;

-        to restrict the processing of Personal Data should one of the instances mentioned in par. 1 of Art. 18 of the above Regulation be applicable;

-        subject to par. 1 Art. 21 of the above Regulation, to object to the processing of your Personal Data;

-        subject to par. 3 and 4 of Art. 20 of the above Regulation, to transmit your Personal Data, namely to receive your Personal Data in a structured, commonly used and machine-readable format, as well as the right to transmit such data to another data controller, should one of the instances mentioned in par. 1 of the above article be applicable;

-        to request a copy of your Personal Data which are subject to processing;

-        to be informed of the rectification or erasure or restriction in the processing of your data;

-        to withdraw your consent to the processing of your Personal Data by our company; and

You should know that your requests regarding rectification, erasure, restriction, access or transmission of your Personal Data are accepted only following the specific written instruction as received from the respective data controller and subject to all legal requirements being met. Should you contact us directly, we shall forward your request as soon as possible to the data controller.

At the discretion of the data controller, the company erases or returns all personal data to the data controller following the conclusion of the provision of data processing services and erases all available copies, unless the storage of the personal data is required by national or European law. Special categories of data are returned immediately to the data controller and the company is not allowed to keep same.
